Terms & Conditions 

Get Quaker Fit Campaign 2025 (“Promo”) is organized by PepsiCo International Pte Ltd with principal office at DUO Tower, 3 Fraser Street, #08-21 Suite No. 187 Singapore 189352, referred to herein as the (“Organizer”). The Promotion is administered by TLC Marketing Worldwide (Singapore) Pte Ltd, a company duly existing under the laws of Singapore (UEN: 201923399W) 1 Harbour Front Ave, Keppel Bay Tower, #05-02 Singapore 098632, referred to herein as the (“Administrator”). All correspondence regarding this Promotion should be directed to this address or through the Promotional Helpline. By participating in this Promo, entrants acknowledge that they have read, understood, and unconditionally agree to comply with and abide by these Terms & Conditions. The decisions of the Organizer for all matters relating to the Promo shall be final and binding in all respects. 

Please note that while the Organizer encourages customers to participate and enjoy the benefits of the Promotion, the Organizer believes in responsible consumption of their products. The Organizer discourages purchasing more product than what consumers can reasonably use or consume just to participate in this Promotion.

1. ELIGIBILITY 

An Entrant is an eligible customer who participates in the promotion (“Entrant”)

1. This Promotion is open to all Singapore citizens, permanent residents, work permit holders, and is valid in Singapore only. 
2. Any employees of the Organizer, (or any of its group undertakings, distributors and its agencies who are directly connected with the creation and administration of this Promotion), and immediate families (spouses, and parents, siblings, children and each of their spouses and household members) are excluded from entering this Promo. 
3. As a condition of entering this Promotion and in the event an Entrant is a Grand Prize Winner, an Entrant consents to the Organizer and/or Administrator using the Entrant’s name and locality in any media in Singapore for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Organizer or Administrator.

2. DURATION

1. Get Quaker Fit Campaign 2025 Promotion Period: This Promotion begins on 2 January 2025 at 12:00 A.M. and ends on 2 July 2025 at 11:59 P.M, or while stocks last (“Promotion Period”), whichever is earlier. Promotion Period is defined as the period when Entrants can make a qualifying purchase of participating SKUs from participating merchants. 
2. Get Quaker Fit Campaign 2025 Redemption Period: This Redemption Period begins on 2 January 2025 at 12:00 A.M. and ends on 2 August 2025 at 11:59 P.M (“Redemption Period”). Redemption Period is defined as the period when the Entrant can submit their Proof of Purchase and claim their reward on the Promotional Website, https://quakerfitclub.sg, (“Promotional Website”).

3. HOW TO PARTICIPATE

1. During the Promotion Period, visit any participating outlets in Singapore and purchase at least one of any Quaker’s Participating Products, specified in the Participating Products List below, during the Promotion Period (“Qualifying Purchase”).
2. For the purposes of this promotion, the Participating Products are as follows but not limited to:

3. The Organizer reserves the rights to include new promotional packs or innovation packs as part of the Participating Products at any point of the campaign.
4. Upon making a Qualifying Purchase during the Promotion Period, Entrants should visit the promotional website, https://quakerfitclub.s, by scanning the QR code found on Participating Products, or point of sale materials, or on Quaker social media accounts (Facebook: https://www.facebook.com/QuakerSingapore/.
5. Once the Entrant lands on the Promotional Website, they will need to fill up and submit a Participation Form (“Participation Form”) by entering the following information:

6. After successful completion of the Participation Form, Entrants will immediately receive a confirmation of their entry submission via email (“Participation Confirmation Email”).
7. Entries and receipts will be reviewed and verified by the Administrator via customer service agents within 2 business days, from the date of entry. 
8. Entrants may take part in the promotion more than once if Entrants have purchased more than one (1) Participating Product in a single receipt. If an Entrant has purchased multiple Participating Products in one (1) receipt, they are required to submit each entry and receipt separately. 
9. Participating Products may not always be available for sale in all participating outlets during the Promotion Period. The Organizer accepts no responsibility for any participating products being unavailable at the participating outlets during the Promotion Period.

4. HOW TO CLAIM STANDARD REWARDS

1. Upon verification, during the Redemption Period, Entrants will receive a confirmation email with steps on how to redeem their reward and a unique Claim Link that redirects them to the rewards page.
2. Entrants can view the available rewards listed in Schedule 1 and claim their choice of one reward via their unique claim link. Upon successful claim, Entrant will receive an email on their e-Voucher pertaining to the rewards details.
3. Claims will be deemed to be received only when acknowledged by the Administrator. The Organizer and Administrator are not liable for any problems with communication networks including but not limited to email blockage, incoming call rejections. If an Entrant enters using automatically generated entries or multiple phone numbers/email addresses/addresses/aliases, they may be disqualified. 
4. All Standard Reward are tax-free, non-transferrable, exchangeable, and non-convertible to cash. The picture of prizes depicted on the press ads/posters/digital materials etc. are only representative. 
5. Each of the Standard Rewards will be bound by the Promotional Partner’s terms & conditions.

5. HOW TO ENTER AND WIN THE GRAND PRIZE DRAW

1. Every successful entry to the promotion will automatically be given an entry to the Grand Prize Draw. 
2. Each Grand Prize is a Resort Vacation Certificate (RVC) (“Certificate”) which is valid towards a one-week (8 days and 7 nights) stay at available resorts worldwide. Terms & conditions are outlined in Schedule 2 below.
3. There will be 1 winner of the Grand Prize drawn every 2 months, amounting to a total of 3 winners throughout the campaign. 
4. All Grand Prize Draw Participation cut-off dates, draw dates, and announcements will be in accordance to Table 1 below:

5. How to claim Grand Prize:
   1. Each winner of the Grand Prize Draw will receive an email (“Congratulatory Email”) confirming they are one (1) of the lucky winners.
   2. The winner will be contacted within seven (7) business days (“Verification Call”) by a nominated agent at any time Monday to Friday between the hours of 9:30am and 5:00pm, excluding weekends and Public Holidays.
   3. Winners will be asked to accomplish a Declaration Form and may be requested to provide a scanned copy or photo of the Promotional Pack and Proof of Purchase. 
   4. Following the successful verification of the winner, Customer Service representatives will serve as the main point-of-contact and facilitate the Resort Staycation booking on behalf of the winner. Customer Service representatives will coordinate with the winner through email and/or phone line.
      1. The winner will receive a travel booking document wherein winner will need to provide their full name, email address, phone number, travel dates, number of persons travelling, details of travel documents and preferred destination and room type.
      2. Destinations and resorts for the Resort Staycation will be subject to availability based on the participating properties under Resort Vacation Certificate provided by the Administrator as outlined in Schedule 2. 
6. In the event the potential Grand Prize Draw winner does not respond to the initial contact within seven (7) business days, the organizer reserves the right to disqualify the winner. If a winner is disqualified, the Organizer reserves the right to return the Prize to the Grand Prize pool which may be won by another Entrant during the Promotion Period.
7. The verified final winner will be announced at Quakers SG Facebook Account https://www.facebook.com/QuakerSingapore/.

6. OTHER GENERAL TERMS & CONDITIONS

1. Entrants may be required to keep the physical receipt as Proof of Purchase, or a photo of the physical receipt as Proof of Purchase wherein the case of an issue, Administrator will require it for verification purposes.
2. Prizes Fulfilment: Where Winners have won a prize, the Organizer will endeavour to fulfil these Prizes within Redemption Period. Rewards are subject to availability and are not exchangeable or redeemable for cash. If a reward is unavailable, for whatever reason, the Administrator or Administrator reserves the right to substitute the reward for a reward of equal value and/or specification, subject to any written approval from the relevant regulatory authorities.
3. In the event that an Entrant or winner is not contacted on their Standard Prize redemption details within two (2) business days or seven (7) business days on their Grand Prize Draw winner details, the Entrant should contact contact@quakerfitclub.sg. If the Entrants do not inform the Organizer/ Administrator within this time frame, the Organizer/ Administrator will reserve the right to not reissue the prize at their sole discretion.
4. Without limiting any other terms of these Terms & Conditions, all prizes (and elements of prizes) must be taken as and when specified or will be forfeited with no replacement. The reward values are correct as of the date of preparing these Terms & Conditions and include any applicable GST. The Organizer and Administrator is not responsible for any change in reward value.
5. In the event the Promotion is unable to proceed as set out in these Terms & Conditions, the Organizer and Administrator reserve the right to vary these Terms & Conditions, subject to any written approval from the relevant regulatory authorities.
6. The Administrator is not responsible for any tax implications arising from an Entrant winning a prize. Entrants should seek independent financial advice.
7. The Promotional Website may contain links to other websites (“Linked Sites”), including websites of Promotional Partners (“Promotional Partner Websites”). The Administrator is not responsible for the content of any Linked Sites, whether or not the Administrator are affiliated with the Linked Sites. The Administrator does not in any way endorse any Linked Sites and is not responsible for the quality or delivery of any products or services offered, accessed or advertised by such Linked Sites. To the extent that these Linked Sites collect personal information or postings from Entrants, the Administrator shall bear no responsibility or liability for the manner in which such information or postings are used or exploited. The Linked Sites are for Entrants’ convenience only, and Entrants agree to access them at their own risk.
8. The Organizer is not liable for entries, reward claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.
9. Any additional or ancillary costs associated with redeeming a reward are not included. Those costs are the responsibility of the Entrant who redeems the reward. Costs associated with redeeming the reward may include, but are not limited to, the Entrant’s transport to and from a participating merchant. Accessing any Promotional Partner Website and downloading, using or installing any Application is the Entrant’s responsibility and at the Entrant’s risk and steps required may vary depending on the internet service or telecommunications provider used.
10. No compensation will be payable to any person if a winner is unable to submit a reward claim in the time and manner set out in these Terms & Conditions for whatever reason.
11. Following the end of the Promotion Period, in the event of any unclaimed or un-won Prize/s, the Organizer reserves the right to conduct a random draw for all non-winning Entrants from the initial round. As this depends wholly on what Prizes will be given out during the initial round of the Promo, the number of Prizes that may be awarded by this second route is unknown. Any winner via this route will be notified via telephone call and/or email. Failure to respond in this manner may result in the winner being disqualified and Prize will not be given out. 
12. HELPLINE: For enquiries: Get Quaker Fit Club Singapore, consumers may call the Promotional Helpline on +65 800 852 8405 between the hours of 9:30am and 5:00pm or email contact@quakerfitclub.sg during the Promotional Period, Monday to Friday, excluding Public Holidays.
13. This Promotion is in no way sponsored, endorsed or administered by, or associated with any social media platform, including Facebook, Instagram and Twitter. Entrants provide information to the Administrator and not to any social media platform. Entrants completely release any relevant social media platforms from any and all liability.

G. LIABILITY & RESPONSIBILITY 

1. The Organizer reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age, place of residence and social media presence) and reserves the right, in its sole discretion, to disqualify any individual who the Organizer has reason to believe has breached any of these Terms & Conditions, tampered with the entry process, engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promo. Errors and omissions may be accepted at the Organizer's discretion. Failure by Organizer to enforce any of its rights at any stage does not constitute a waiver of those rights. 
2. In the event that the Promo is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Organizer which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promo, the Organizer reserves the right to disqualify any individual who tampers with the entry process or does not comply with these Terms & Conditions and to cancel, modify or suspend the Promo or invalidate any affected entries.
3. No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. The Organizer does not guarantee continuous or secure access to the Promo web entry page. 
4. Organizer together with any associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promo or accepting or using a Prize, except for any liability which cannot be excluded by law. 
5. An entry must be made directly by the individual entering the Promo via their unique email address. Bulk entries from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries and entries submitted by macros or other automated means together with entries which do not satisfy the requirements of these Terms & Conditions in full will be disqualified and will not be counted. If it becomes apparent that an Entrant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that Entrant’s entries into the Promo in a way that is not consistent with the rules of the Promo, that Entrant's entries will be disqualified and any Prize awarded will be withdrawn.
6. The Organizer will not be liable for any failure to comply with its obligations or any delay in performing its obligations within these terms & conditions. If an act, omission, event or circumstance occurs caused by (but not limited to) global or regional health crises, weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, epidemic, pandemic, famine, plague or other natural calamities and acts of God, or any other circumstances beyond the reasonable control of the Organizer.
7. The Organizer may refuse to award a Prize in the event of any Entrant’s fraud, dishonesty, breach or non-entitlement under these Terms & Conditions or seek recovery of its value if a Prize has been awarded.
8. Any and all personal data provided by you in connection with this Promo will be used solely by the Organizer (or its appointed agents) to: (i) assist with running the Promo; and/or (ii) conduct analytics to improve the Organizer’s promotions, products or services. The Organizer (or its appointed agents) will not contact you for reasons other than this Promo unless you have provided your express consent. All personal data will be handled in accordance with the Organizer’s privacy policies.
9. If any provisions of these Terms & Conditions are judged to be invalid, illegal or unenforceable, this will not affect or impact the continuation in full force and effect the remainder of the provisions.
10. By entering this Promo, you will be deemed to have agreed to be bound by these Terms & Conditions.

In the event of a discrepancy between these Terms & Conditions and the details in any promotional material, the details in the Terms & Conditions will prevail. 

11. By entering the Promo, each Entrant agrees:

1. to be bound by these Terms & Conditions and by all applicable laws and by the decisions of Organizer which shall be binding and final;

2. to waive any rights to claim ambiguity with respect to these Terms & Conditions 

3. to waive all his or her rights to bring any claim, action or proceeding against any of the Released Parties in connection with the Promo; and

4. That all personal details submitted by each user must be accurate, complete and are subject to provision of proof upon request of the Organizer. Any inaccurate or incomplete information found in a submission will result in disqualification of the user

5. That the Organizer has the sole discretion to disqualify any photograph or screenshot which may be obscene, profane, lewd, defamatory, threatening, harassing, libelous, deceptive, invasive of another’s privacy, offensive or inappropriate in any manner whatsoever

6. That the Organizer reserve the right to change/modify terms & conditions and/or criteria of the Promo and/or the Prize for the Promo and/or the duration/timing of the Promo, at any time at their own discretion and without any prior notice and without assigning any reason

7. To grant the Organizer irrevocable consent in perpetuity to the use his/her and/or person’s involved name, photographs, video submitted and/or taken during the Prize distribution in connection with the Promo, in any and all applications including but not limited to advertising, commercials, promotion, stories, text, articles and commercial exploitation, in any and all media forms, including but not limited to radio, broadcast and television, newspapers and magazines at any time without the Entrant’s further knowledge or consent

8. Organizer shall not be responsible for any complaints regarding the quality of the prize. The manufacturer shall continue to be liable for the prizes, wherever applicable.

9. To forever and irrevocably agree to release, defend, indemnify and hold harmless each of the Released Parties from any and all claims, lawsuits, judgments, causes of action, proceedings, demands, fines, penalties, liability, costs and expenses (including, without limitation, reasonable outside attorneys’ fees) that may arise in connection with:

   1. the violation of any third-party privacy, personal, publicity or proprietary rights;

   2. typographical or printing errors in these Official Rules or any Promo materials;

   3. acceptance, attendance at, receipt, travel related to, participation in, delivery of, possession, defects in, use, non-use, misuse, inability to use, loss, damage, destruction, negligence or wilful misconduct in connection with the use of a Prize (or any component thereof);

   4. any change in the prizing (or any components thereof) due to unavailability or due to reasons beyond the Released Parties control, including but not limited to by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi- governmental entity (whether or not such action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, threatened or actual terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labour dispute or strike (whether legal or illegal), labour or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot or any other cause beyond any  of  the  Released  Parties’ control, or as otherwise permitted in these Terms & Conditions Rules;

   5. any interruptions in or postponement, cancellation or modification of the Promo;

   6. human error;

   7. incorrect or inaccurate transcription, receipt or transmission of any part of any entry (including, without limitation, the registration information or any parts thereof);

   8. any technical malfunctions or unavailability of the Page or any telephone network, computer system, computer online system, mobile device, computer timing and/or dating mechanism, computer equipment, software, or Internet service provider, or mail service utilized by any of the Released Parties or by an Entrant;

   9. interruption or inability to access the Promo, the Page or any other Promo-related websites or any online service via the Internet due to hardware or software compatibility problems;

   10. any damage to Entrant’s (or any third person’s) equipment used to access the Promo and/or its contents related to or resulting from any part of the Promo;

   11. any lost/delayed data transmissions, omissions, interruptions, defects, and/or any other errors or malfunctions;

   12. any late, lost, stolen, mutilated, misdirected, delayed, garbled, corrupted, destroyed, incomplete, undeliverable, or damaged entries;

   13. any wrongful, negligent, or unauthorized act or omission on the part of any of the Released Parties;

   14. lost, late, stolen, misdirected, damaged, or destroyed prizing (or any element thereof); 

   15. the negligence or willful misconduct by Entrant; and/or

   16. violation on any rule, regulation, law regarding Covid-19 prevention and safety.

10. Warranty: Without limiting the foregoing, everything regarding this Promo, including the Page and a Promo Prize and/or all Prize component(s), are provided “as is” without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a purpose or non-infringement.

12. DISPUTES: Except where prohibited, Entrants agree that: a)  any  and  all  disputes, claims and causes of action arising out of or connected with this Promo or any Prize awarded shall be resolved individually, without resort to any form of class action; b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promo, but in no event attorneys’ fees; and c) under no circumstances will Entrant be permitted to obtain  awards  for,  and  Entrant hereby  waives  all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Entrants agree that the statute of limitations for asserting any claims shall be a period of one (1) year from the time the cause of action accrued, or the cause of action shall be forever barred.
13. PRIVACY POLICY: Any personally identifiable information collected during an Entrant’s participation in the Promo will be collected by the Organizer or its designee and used by Organizer’s, its affiliates, designees, agents and marketers for purposes of the proper administration and fulfilment of Promo as described in these Terms & Conditions and in accordance with the Privacy Policy of the campaign.
14. WINNER WAIVER OF CLAIMS: By accepting a Promo Prize, a winner agrees to voluntarily waive, release and relinquish any and all claims, damages, losses, expenses, remedies, demands, debts, obligations, causes of action and/or claims for relief (collectively “Claims”) that a winner may have against the Released Parties and agrees to discharge, to indemnify and hold harmless the Released Parties from all Claims arising out of or relating to the Promo and/or a Promo Prize, including but not limited to Claims for bodily injury, personal injury, emotional distress, property damage, or death and/or dismemberment (collectively “Damages”) occurring to a winner or others. In addition, by accepting a Prize, a winner agrees to be responsible to research the details about a Prize including any inherent dangers associated with a Prize and as a result agrees to accept personal responsibility for any such dangers and any resulting Damages.

CAUTION AND WARNING: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE, THE PAGE, OR TO UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMO IS A VIOLATION  OF  CRIMINAL  AND  CIVIL  LAWS.  SHOULD  SUCH  AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Schedule 2: GRAND PRIZE - ADDITIONAL TERMS TO RESORT VACATION CERTIFICATES (RCI)

1. Each Grand Prize is a Resort Vacation Certificate (RVC) (“Certificate”) which is valid towards a one-week (8 days and 7 nights) stay at one of the 1,334 participating properties worldwide. 
2. The Grand Prize will be administered and booked directly by the Administrator as outlined in Section E.5.d.
3. Destinations and travel times are subject to availability and confirmed on a first come, first served basis.

5. Certificate includes only accommodations and specifically excludes travel costs, taxes, all-inclusive fees (as applicable), and other expenses that may be incurred. 
6. Promotional discounts and offers may not apply to all properties. Offer may not be combined with any other promotion, discount, or coupon. Offer void where prohibited by law. 
7. All prices are based in U.S. dollars (USD). Certificates are for redemption during shoulder and off-season periods. Additional terms & conditions, including upgrade fee options, are available when you redeem the Certificate.

9. Entrants must provide their details during booking using their legal name stated on valid identification card or passport. Organizer reserves the right to disqualify any Entrant who provides multiple names or email addresses and to require them to forfeit the prize. Organizer will require such valid information as it considers reasonably necessary for this purpose and a Prize may be withheld until the Organizer is satisfied with the information provided by Entrant as part verification.
10. Grand prizes fulfilment: the Organizer will endeavour to fulfil the booking within 14 business days upon confirmation of travel dates of the winner(s). If for any reason the booking cannot be fulfilled within this timeframe, the Organizer will contact the winners who will be given the choice of either waiting for their booking to go through or accepting a specified alternative Prize which will be of equal value.
