Terms & Conditions for FairPrice Christmas Festive Car Draw | 16 Nov - 27 Dec 2023

A. Terms & Conditions:

This FairPrice Festive Car Draw (“Campaign”) is organised by NTUC FairPrice Co-operative Limited (“the Organiser”).

 

You are eligible to join the Campaign only if you agree to and accept the following terms and conditions ("Terms and Conditions"). Please read these Terms and Conditions carefully before participating in the Campaign. By participating in the Campaign, you agree to be bound by these Terms and Conditions and any subsequent amendments, additions, replacements, variations and modifications.

 

The Organiser reserves the right to disqualify and/or exclude any entries from the Campaign, for any reason and for no reason, including without limitation, violation of any part of these Terms and Conditions.

 

1) Qualifying Entrants

 

a) The Campaign is open to all residents of Singapore aged 18 years and above as of the date of participation, with exception to the following:

(i) Employees of the Organiser and their immediate family members;

(ii) Employees of the advertising, creative and promotion agencies of the Organiser and any other parties which are directly involved in organising, promoting and/or conducting the Campaign.

 

b) You warrant and represent to the Organiser that as of the date of participation, you are aged 18 years and above, otherwise your parent/guardian has consented to your participation in the Campaign after reading and agreeing to all the Terms and Conditions herein which shall be binding on both you and your parent/guardian. You shall indemnify and hold harmless the Organiser and its affiliates from and against any claim, action, damage, loss, costs and expenses (including legal fees and professional fees) arising from its reliance on your undertaking and representation herein.

 

2) Campaign Period and Campaign Mechanics

 

a) The Campaign Lucky Draw is valid from 16 November 2023 - 27 December 2023 (both dates inclusive) (“Campaign Period”).

 

b) Tier 1 Mechanic (“Tier 1”) minimum S$30 spent in a single receipt (“Qualifying Spend”) at all FairPrice stores, FairPrice Finest, FairPrice Xtra, FairPrice Shop, Scan & Go, Warehouse Club, Unity Stores (excluding Unity Changi Airport T3), or on FairPrice web [https://www.fairprice.com.sg/] or app to participate in the Campaign. Each Qualifying Spend entitles you to one entry in the Campaign’s Lucky Draw (“Lucky Draw Entry”).

 

c) Tier 2 (“Tier 2”) additionally, minimum $30 spent at all FairPrice stores, FairPrice Finest, FairPrice Xtra, FairPrice Shop, Scan & Go, Warehouse Club, or on FairPrice web at [https://www.fairprice.com.sg/] or app with at least one Participating Product (“Participating Product”) will qualify for maximum one bonus chance (“Bonus Chance”) in Tier 2 of the Lucky Draw.

 

d) Purchases of the following items will not be included in the calculation of minimum Qualifying Spend: 4D, TOTO, Singapore Sweep, FairPrice Gift Vouchers and Gift Cards, cigarettes, infant milk powder (0 – 12 months), newspapers, magazines, prescription and pharmacy-only-medicines.

 

e) There is no limit to the number of Lucky Draw Entries one may submit. However, each qualifying participant is eligible to win only one Prize for the Campaign (defined below), regardless of the number of Lucky Draw Entries.

 

f) A maximum of 30 Lucky Draw stubs will be generated in 1 transaction.

 

g) For online purchases on FairPrice web or app, the following additional terms and conditions shall apply to be eligible for a Lucky Draw Entry:

(i) Qualifying spend will exclude all discounts, promotions, offers, promo codes, delivery fees and services fees, unless otherwise stated;

(ii) Chances are calculated based on the final invoiced amount after delivery. Chances will take into consideration of any post order amendments;

(iii) Not applicable for purchases made by Corporate customers;

(iv) Order and delivery must be completed during the Campaign Period. For the avoidance of doubt, order made during the Campaign Period but delivery is completed after the Campaign Period will not qualify for a Lucky Draw Entry; and

(v) Must opt-in to “Lucky Draw” and the name of the FairPrice account holder together with a contactable mobile number is updated in the FairPrice Group app before 30 November 2023. This can be done by going to your FairPrice account and selecting “Lucky Draw” under “Preferences”. Upon successful update of the foregoing, Lucky Draw Entries will be automatically calculated for every Qualifying Spend.

h) Participants who pay via the FairPrice Group app at at all FairPrice stores, FairPrice Finest, FairPrice Xtra, FairPrice Shop, Scan & Go, Warehouse Club, and those using Scan & Go must opt in to “Lucky Draw” under Account > Preferences on the FairPrice Group app before their transaction.

 

i) Other than purchases made via FairPrice Online and payment using FairPrice Group app at all FairPrice stores, FairPrice Finest, FairPrice Xtra, FairPrice Shop, Scan & Go, Warehouse Club, or Scan & Go (in which the above paragraphs 2(g) and (h) shall apply respectively), in order to participate in the Campaign, fill in your name (as per NRIC) and contact number on the Lucky Draw Stub and drop it into the designated Lucky Draw box provided in any participating FairPrice stores. Any and all stubs with incomplete or illegible information will be disqualified. Only original stubs are accepted. Photocopies are not allowed.

 

j) For customers who pay via the FairPrice Group app, no physical Lucky Draw Stubs will be printed by the cashier or at the self-checkout machine. The Lucky Draw Entries will be reflected in the FairPrice Group app (in which the above paragraph 2(h) shall apply respectively).

 

k) For customers who make an online order and are qualified to enter the draw, the entries will be reflected in the FairPrice Group app. Their chances will be drawn electronically using FairPrice’s system together with the physical draw of Lucky Draw Stubs.

 

l) The Organiser reserves the right to disqualify any participant who is found or suspected of tampering with the Lucky Draw Entry submission process and/or operation of the Lucky Draw Entry.

 

m) The Participating Products stated in the table below are available at all FairPrice stores, FairPrice Finest, FairPrice Xtra, FairPrice Shop, Scan & Go, FairPrice Online and Warehouse Club. While stocks last. The number of Participating Products purchased in a transaction will not garner additional bonus chances. Only the exact product SKU in the exact pack size and variant will generate an additional chance. A different flavor or pack size will not generate any additional chance.

3) Winners & Prizes

 

a) A total of 4 lucky Winners (“Winners”) will be selected during the draws to be conducted at No. 1 Joo Koon Circle #13-01 Singapore 629117 on the date and at the time specified in the table below.

 

 

b) Physical Lucky Draw Entries from stores will be collected every week and all qualifying FairPrice Online purchases will be included in the draw. A computerized random list generator will determine which pile the winner and reserves will be extracted from. All Lucky Draw Entries will be snowballed into the subsequent draw(s).

 

c) Grand Winner will be entitled to one (1) MG HS EXCLUSIVE 1.5L TURBO SUV CAR (PHANTOM RED) (“Prize”). For clarity, the Prize is NOT inclusive of the following:

• Certificate of Entitlement (“COE”)
• Vehicle Emissions Scheme (VES) surcharge, if applicable
• Servicing Program
• Motor Vehicle Insurance
• Road Tax
• IU Installation
• Number Plates
• Goods and Services Tax (GST)
• Registration Fee
• All Locally Fitted Items

 

d) Grand Winner’s entitlement to the Prize is subject to the terms and conditions of Eurokars EV Pte Ltd. (“Eurokars EV”) distributor of the Prize in Singapore, which can be found at https://go.fpg.sg/Eurokars-T&C (“Eurokars T&Cs”).

 

e) All Winners will be notified by phone call at the number indicated in the Lucky Draw Entry by the following Monday from the date the draw is conducted. For illustration, for Draw 1 which will be conducted on 30 November 2023, the Winner will be contacted by 4 December 2023. The Organiser will not be held liable in the event any eligible Winner cannot be contacted for whatsoever reason. Phone calls to winners will be made by FairPrice phone number starting with 6888.

 

f) The Organiser will require Winners to provide a valid identification document for verification purpose before awarding the Prize. The Organiser reserves the right to withhold the Prize pending verification of the Winner’s compliance with these Terms and Conditions.

 

g) In the event that a Winner (i) is not contactable or does not respond to Organiser within 24 hrs from point of contact via phone; (ii) refuses to provide a valid identification document for verification purpose; (iii) not agree to Eurokars EV T&Cs; (iv) not consent to the Organiser disclosing her/her personal data to Eurokars EV for the purposes of Prize collection or delivery; (v) has breached any Terms and Conditions herein; or (vi) his/her Lucky Draw Entry is invalid for whatever reasons, his/her Prize will be forfeited.

 

h) Results of the weekly draw will be published in the newspaper (Straits Times) and the FairPrice Website - (https://www.fairprice.com.sg/promo/festive-draw/) at least 7 days after the date of the draw.

 

i) A representative from Eurokars EV will contact the Winner(s) within 14 calendar days from the online publication date on FairPrice website for the Winner(s) of the Prize(s) (“Online Publication Date”), for matters relating to collection / delivery of the Prize(s).

 

j) Any Prize remain unclaimed after two (2) months from the Publication Date will be donated to charity.

 

k) In the event that any Winner is disqualified from the Campaign, the Organiser, at its sole discretion, may decide whether a replacement Winner should be selected. In this event, any further Winner will be selected on the same processes as set out in these Terms and Conditions. The Organiser can repeat this process any number of times until it has selected a satisfactory Winner in accordance with these Terms and Conditions.

 

l) No person shall be entitled to any payment or compensation from the Organiser or Eurokars EV should the Prize or any part thereof be forfeited in accordance with these Terms and Conditions.

 

m) The Organiser’s decision regarding selection of Winners is final. Any correspondences, enquiries or appeals made including appeals to check the status of Lucky Draw Entries, will not be entertained.

 

n) Prizes are non-transferable, given on an “as is” basis and non-exchangeable for cash or other items. The Organiser reserves the right to substitute any Prizes with items of similar value without prior notice.

 

4) Liabilities

The Organiser, its affiliates and their advertising, creative and promotion agencies (i) makes no warranties or representations regarding the quality, merchantability, fitness of purpose or any other implied terms and conditions in relation to the Prize, and (ii) to the extent permitted by applicable law, shall not be liable in any manner whatsoever for the following:

 

a) any cost or expense incurred by participants for taking part in this Campaign or in the collection of the Prizes by Winners;

 

b) any consequences, including but not limited to, any claim, loss of life, injury, defect or damage, that arises out of or in connection with this Campaign or use of the Prizes;

 

c) intervention by unauthorized parties during the Campaign Period;

 

d) electronic or human errors in the administration of the Campaign and processing of Lucky Draw Entries (including any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, or any problems or technical malfunction of telecommunications network or lines, computer online systems, server or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the internet); and

 

e) any lost or unsuccessful attempts to contact and notify any Winners.

 

5) Use of Personal Data

a) All information, including personal data (“Information”) submitted or known to Organiser and/or its affiliates in connection with this Campaign will only be used for the purposes set out herein and be treated in accordance with these Terms and Conditions and those stipulated in the Privacy Notice of Organiser found at: https://help.fairprice.com.sg/hc/en-us/sections/360004061672-Privacy-Notice (“Privacy Notice”).

 

b) By participating in the Campaign, you agree to grant and authorize Organiser the right to collect, use, process and disclose your name, address, contact information and other personal data, without remuneration or compensation, for the purposes of:

i) the conduct and administration in relation to the Campaign (including without limitation the collection / delivery of Prizes to the Winners);

ii) Organiser’s promotional and marketing purposes; and

iii) for any and all purposes set out in the Privacy Notice.

 

c) By submitting the Campaign entries, you acknowledge that in respect of any Information you provided:

i) you are authorized to disclose such Information; and

ii) such disclosure complies with the applicable laws and regulations on data protection, and the Organiser together with its affiliates have the right to use such Information for the purposes set out above. You shall hold the Organiser, its affiliates and their respective officers, directors and employees free and harmless from any liability arising from claims or suits of third parties, including costs and expenses incidental thereto, in connection with its use of the Information.

 

d) Acceptance of any Prize shall constitute consent on the Winner's part to allow the use by Organiser of the Winner's name, image, voice, likeness and/or the fact that the Winner won the Prizes for editorial, advertising, promotional, marketing and/or other purposes without further notification, remuneration or compensation to the Winner. The Winner agrees to cooperate with and participate in any and all activities organized by Organiser for these purposes.

 

6) Miscellaneous

a) The decisions of the Organiser on all matters relating to or in connection with the Campaign, including the Campaign Period and selection of winners, are final, conclusive and binding. The Organiser shall not be obliged to give any reason or enter any correspondence with any person on any matter concerning the Campaign.

b) Organiser reserves the right, at any time without prior notice and without any liability to any person, to (i) modify, suspend and/or terminate the Campaign (in whole or in part); (ii) amend any of these Terms and Conditions; (iii) change the date, time and venue of the draw; or (iv) substitute any Prize with one of similar value.

c) In the event of disputes regarding the Campaign or these Terms and Conditions, the Organiser shall have the right to make the final decision. The decision of the Organiser on all matters relating to the Campaign is final, conclusive and binding.

d) In the event of any inconsistency between these Terms & Conditions and any advertising, promotional, publicity and other materials relating to or in connection with the Campaign, these Terms & Conditions shall prevail.

e) FairPrice acknowledges and agrees that Apple is not involved in and has no responsibility in relation to the operation of this FairPrice Festive Draw. Any comments, queries or claims relating to FairPrice Festive Draw shall be addressed to FairPrice only and not to Apple.

f) The Campaign and these Terms & Conditions shall be governed by the laws of the Republic of Singapore and all Participants (including the Winners) are deemed to have agreed to submit to the exclusive jurisdiction of the Singapore Courts.

g) A person who is not a party to any agreement governed by these Terms & Conditions shall have no rights under the Contracts (Rights of Third Parties) Act 2001 to enforce any terms of such agreement.
